Downtown Nashville concentrates bars, restaurants, hotels, concerts, sporting events, rideshare traffic, and late-night driving into a relatively small area. DUI investigations frequently begin after a driver leaves Lower Broadway, The Gulch, Midtown, Demonbreun, or another nightlife district.

Can I Refuse Field Sobriety Tests?
Field sobriety tests are different from Tennessee's chemical-test and implied-consent rules. Whether the tests were voluntary, how they were explained, where they were performed, footwear, physical conditions, lighting, traffic, weather, and the officer's administration can all matter.
Downtown conditions are not always ideal testing conditions. Uneven surfaces, noise, crowds, flashing lights, fatigue, and footwear can affect what a video appears to show.
What About a Breath or Blood Test?
Chemical evidence can be powerful, but it is not beyond challenge. The defense may examine the timing of the test, collection and handling, instrument or laboratory procedures, chain of custody, medical issues, and whether constitutional and statutory requirements were followed.
Tennessee's DUI law uses a .08% alcohol-concentration threshold for most adult noncommercial drivers, while impairment can also be alleged without a .08% result.
What Are the First-Offense Penalties?
Tennessee's Department of Safety currently lists a first DUI conviction as carrying at least 48 hours in jail, a $350 to $1,500 fine, and a one-year license revocation. A .20% or higher alcohol concentration increases the listed minimum jail period to seven consecutive days.
Ignition-interlock and other statutory requirements can also apply. A DUI conviction can create insurance, employment, professional, travel, and licensing consequences beyond the sentence itself.
What If I Was Visiting Nashville?
Tourists face an extra layer of logistics. A defendant may be released and return home before the first Davidson County court date. Whether the defendant can avoid a particular return trip depends on the court and proceeding; virtual appearances in General Sessions are determined by the assigned judge.
Do not assume an out-of-state address excuses attendance. Resolve appearance questions before the court date.
